We aim to include new Market Actors through our value chain extension which will allow ‘pass-through’ connection in those cases where an existing actor passes services through a new actor enabling them to give more to the ecosystem without compromising the security or the role of the heavily regulated financial institutions.

PURPOSE
The main purpose of the Manager Compliance is to ensure that the organisation implements an effective compliance framework and processes and complies with all applicable laws and binding regulations (specifically, the PASA and SARB requirements), considers adherence to non-binding rules, standards and codes, specifically the King code of Corporate Governance and to manage information and data within BankservAfrica in compliance with the POPI, PAIA Acts and other related legislation.

Your key responsibilities include:
- Develop the functional BU strategy aligned to group strategy,
- Ensure strategy and goals are cascaded to the team
- Identify and lead innovation by identifying efficiencies, challenging the status quo of business processes and drive continuous improvement initiatives
- Demonstrate innovative thinking in area of expertise and translate this into business process/ solutions/ working practice improvements
- Deliver client or company specific projects in line with company standards and in agreement with line manager
- Develop and maintain the BankservAfrica regulatory universe.
- Develop, maintain and revise appropriate Compliance Plans and related policies and procedures, and provide assistance and training on applicable legislation, codes, policies and any other compliance related issues
- Conduct compliance monitoring to verify compliance with applicable laws, regulations, contractual obligations, policies, procedures and standards, and in particular:
- SARB commitments
- PASA guidelines BIS FMI principles
- Privacy regulations
- Regulatory changes
- Perform independent reviews to ensure that compliance issues are appropriately investigated and resolved.
- Ensure proper identification and reporting of violations or potential violations and recommend action plans for resolution of issues and provide general guidance.
- Ensure the effective collaboration and integration with the internal audit, enterprise risk management, and information security and governance functions.
- Develop and maintain data lifecycle framework for BankservAfrica.
- Provide legal and compliance advice in relation to POPI, PAIA and related legislation.Ensure that policies, procedures, agreements, and practices comply with commercial, intellectual property (IP), privacy, data protection and competition laws as well as all other statutory requirements.
- Implementation of processes and controls to record and monitor requests for access to information, collection and safe storage of personal information in compliance with the Promotion of Access to Information Act 2 of 2000 (PAIA) and Protection of Personal Information Act 4 of 2013 (POPI).
- Liaise with various Departments to create public information communications and procedures on privacy efforts, related issues, and breaches as well as to ensure standards of disciplinary action and sanction for non-compliance.
- Coordinate the scheduling of Board, Committee and Forum meetings and related processes
- Take responsibility for compilation of reports, preparing agendas, physical and electronic production, and distribution of reports of Board, Committee and Forum meetings and related processes
- Ensure decisions at meetings are enacted and dealing with any follow up activities
- Liaise with Members and Directors relating to the coordination of meetings/appointments and referral of matters to other employees for response where appropriate
- Work with the Company Secretary and Company Secretarial, Governance and Internal Regulations Manager on delivering governance events
QUALIFICATION / KNOWLEDGE
- B Comm /BCom(Law) / LLB or similar commercial B. degree
- A C. Prac (SA), would be an advantage
- Membership with the Compliance Institute of SA or other professional organisations
- Between 8 and 10 years’ experience in financial sector regulatory compliance
- MS Office Suite
EXPERIENCE
- A Considerable knowledge of the principles and practices of compliance monitoring that provide assurance on the level of assurance as annual compliance and monitoring plans
- Experience and understanding of relevant legislation and ancillary knowledge and skills related to information management.
- A detailed knowledge and experience in respect of various South African legislation
